Chocolate and Love may terminate your account at any time if Chocolate and Love should determine that you are not using the site in compliance with these Conditions or if Chocolate & Love believes the information provided by you is untrue, inaccurate or incomplete.
By shopping or browsing on this site, you acknowledge that you have read, understood, accept and agree to be bound by the Conditions set out hereunder and the other policies displayed on this site.

Privacy Policy
Information requested
We ask for your name, e-mail and mailing addresses, credit card number and expiration date and the phone number. We need this information to process and fulfill your orders, and to notify you of your order status. No sale of information to third party
We do not sell or trade your personal information to advertisers, marketers, or anyone else without your consent. We do however reserve the right to disclose information regarding our members and usage of the site to our advertisers, suppliers and other selected third parties and / or may disclose personal information in response to a specific request by a law enforcement agency, court order or as required by law.
Availability, prices and changes of products
Availability
All products displayed on this site are subject to availability.
GBP and VAT
All prices displayed on the site are quoted and are payable in GBP and are fixed and valid and are not subject to any fluctuations in exchange rates wheresoever. The prices include Value-Added Tax and exclude postage.
Changes
Chocolate and Love reserves the right without prior notice to discontinue or change specifications and / or prices on products and services offered on this site without incurring any obligations.
Ordering
Confirmation of Orders
When you click to make a purchase with us, legal obligations arise. Accordingly all orders placed by you on the site constitute your offer to purchase our products on the Conditions set out under this document. Your offer is deemed to have been accepted by Chocolate and Love on receipt thereof.
Prices
You will be charged the prices as they are reflected on the website, subject to availability.
Payment
Payment options
We accept charge and credit cards issued by VISA and MasterCard.
You can safely send us your credit card number via our secure server, which uses encryption to protect your personal information. Bank transfers may be used for payment in which case you are kindly asked to contact us at info@chocolateandlove.com. A confirmation of payment must be emailed to us before the order can be processed and dispatched.
Please note if Chocolate and Love is not satisfied with a credit card transaction for any reason we may request an alternative payment. This is for your protection to ensure no fraudulent transactions occur.
Warrant and authorisation
By submitting your order and Payment Card details you warrant that you are over the age of 18 (eighteen), are authorized to make payment with the Payment Card and that there are sufficient funds available to pay for the order. At the time of placing an order, the transaction details are presented to the bank and an authorisation requested for the amount of the order.
Security
Virtual Card Services (VCS) process all credit card transactions.
Virtual Card Services is committed to providing secure online services. All encryption complies with international standards. Encryption is used to protect the transmission of personal information when completing online transactions. Virtual Card Services Internet servers are protected by firewalls and intrusion detection systems.
Chocolate and Love does not have access to credit details of customers ordering from its website.
Verification email serves to inform you that a purchase has been made.
Cancellation
Open orders
As long as the order is open, you can cancel the order and no money will be charged to your card.
An order is open if the dispatch process has not commenced ie the process of packing the chocolates and preparing them for dispatch from our fulfilment facility.
To find out if your order is open, click My Account at the top of any page. On the "My Account" page, click "Order status & history track". If your order is listed as "open" you can cancel an order. If your order is listed as "Dispatch process started" unfortunately it is not possible to make a cancellation. If you would like to return any items after delivery, please see Returns & Refunds and follow the instructions.
Closed orders
If for any reason you would like to cancel a closed order (and your order may already been packed and shipped) Chocolate and Love shall be entitled to debit your payment card for delivery fees incurred in respect of any cancellations. Delivery fees are excluded and are stated as a separate cost and therefore all cancellations are granted for the product purchase price only and excluding shipping cost incurred.
Without prejudice to any other rights or remedies in law, Chocolate and Love shall be entitled to cancel forthwith any sale and/or your registration if you should breach any of your obligations, this being without prejudice to claim damages incurred in consequence of any such breach.
Delivery
Delivery address
Products are delivered to the address indicated by the Customer on the order within a reasonable time.
This is defined on the website according to when the order is placed and the conditions specific to the shipping carrier. The shipping time indicated is for information only and is not guaranteed. Chocolate and Love cannot be held responsible for delivery delays for reasons beyond our control for example, recipient unavailability.
Any person other than yourself who receives the products at the delivery address is conclusively presumed to be authorized to accept delivery on your behalf.
You are required to ensure that you or an authorised person shall be in attendance at the delivery address and that appropriate access will be made available.
Returns & refunds
Lost / incorrect or damaged products
If the order was damaged upon arrival or was lost, customers must notify Chocolate and Love within 24 hours by e-mail at: info@chocolateandlove.com.
On receipt of the compliant or notice referred to above, Chocolate and Love will investigate the query.
If Chocolate and Love supplies the wrong product or if the product is in anyway damaged as a result of packing or packaging, then Chocolate and Love will exchange it for a new product.
Please note the customer returning the product must send an email stating he/she is returning the product.
Only the person who made the payment for the product may make use of this returns policy. If for any reason the product cannot be replaced Chocolate and Love will refund the full purchase price (excl. shipment).
Dissatisfaction
Incorrect delivery address
Chocolate and Love cannot be held responsible if the addressee/recipient is not present/available at the time of delivery and/or if the customer does not collect product/s at the couriers office, after the courier delivers a note to the addressee/recipient to that effect.
Chocolate and Love cannot be held responsible for incorrect or invalid delivery address details. Chocolate & Love processes all orders based on the order form information. A delivery address may be changed via email. Chocolate and Love will not be held responsible for any delays resulting from delivery address changes, product rerouting or recalls.
Return slip
When you like to return a product, you are kindly asked to contact us at info@chocolateandlove.com for a Return slip. The wrapping on the product must be unsealed. Please write the reason for your return on the Return slip. Enclose the slip in the carton, wrap the package securely and send it to the address on the Return slip. The product must be returned to us with in 14 days of receipt of the product.
We will refund you the price of the product.
Gift voucher
Please contact us at info@chocolateandlove.com if you are interested in purchasing a Gift voucher.
Gift vouchers can be exchanged to the value indicated.
Gift vouchers expire one year from the date of issue.
Gift vouchers cannot be exchanged for cash or for goods already supplied.
Gift vouchers may be exchanged for goods of a higher price than its face value on payment of the difference.
No change will be given.
If you return an item paid by gift voucher, we will credit your account with the value of the item. No cash/credit card refunds will be given.
Chocolate and Love reserves the right to cancel gift vouchers at any stage and reimburse the original purchaser.
Chocolate and Love will not be liable in the event of voucher being lost or stolen.

All materials on this web site are protected by copyright unless otherwise noted and may not be used except as permitted in these terms and conditions or with the express written consent of Chocolate and Love, including copyright in all material, designs, logos and graphics.
All data and information communicated to or from the site and/or any site information and database remain and shall be the sole property of Chocolate and Love.
You may download material displayed on the website for your non-commercial and personal use. This permission is specifically conditional upon your retaining all copyright and other proprietary notices contained on the materials. You may not distribute or transmit modify, reuse, report, or use the contents of the website for public or commercial purposes without written permission from Chocolate and Love.
Choice of law
These terms and conditions are to be governed by and construed in accordance with the laws of the UK.
